     The EB-5 Immigrant Investor Program allows eligible foreign investors and their immediate family members (spouse and children under 21) to obtain U.S. permanent residency (a green card) by investing in a U.S. business that creates jobs for U.S. workers. 


     

    • $800,000 if investing in a Targeted Employment Area (TEA), which is an area with high unemployment or rural areas.
    • $1.05 million for areas outside of a TEA.


     

    • Job Creation: Your investment must create at least 10 full-time jobs for U.S. workers.
    • At-Risk Investment: The investment must be at risk and cannot be guaranteed.
    • Active Involvement: While direct involvement in day-to-day operations is not required, the investor must be involved in the business at a policy-making level.


     Yes, your spouse and children under the age of 21 can be included in your EB-5 application. 


      Once the I-526 petition is approved, you can apply for an EB-5 visa through consular processing (if outside the U.S.) or apply for an adjustment of status (if already in the U.S.). Upon approval, you and your family will receive a conditional green card valid for 2 years. 


      A conditional green card is issued for a two-year period. During this time, you must prove that your investment has created the required jobs. After 2 years, you can file the I-829 petition to remove the conditions and obtain a permanent green card. 


     While the USCIS website states a new cycle time goal of 6 months for processing I-526 and I-485 forms, it is important to note that the actual timeline may be much longer. In most cases, it takes between 18 to 24 months from the date of filing the I-526 petition to receiving the conditional green card. However, this timeline can vary depending on individual circumstances and current processing times. It is important for applicants to be aware of this potential delay and plan accordingly.

     The I-829 petition is filed after receiving the conditional green card. It is used to remove the conditions on your green card by proving that your investment has created the required jobs and met all EB-5 program requirements. 


    Yes, after holding a permanent green card for 5 years, you may be eligible to apply for U.S. citizenship through naturalization.


     You do not need to live in the U.S. while your I-526 petition is being processed, but you must be physically present in the U.S. to apply for an adjustment of status. You can also apply for a U.S. visa through consular processing if you are outside the U.S.

     Yes, there are several additional fees, including:

    • Filing Fees for the I-526 and I-829 petitions

    • Legal Fees for the EB-5 application process
    • Investment Fees depending on the chosen EB-5 project


     The DS-260 is the Immigrant Visa and Alien Registration Application form. If you are applying for an EB-5 visa through consular processing, you must complete this form after your I-526 petition is approved and before your visa interview at the U.S. consulate. 


     A Targeted Employment Area (TEA) is a rural area or a high-unemployment area (typically with an unemployment rate of 150% or more of the national average). Investing in a TEA allows the minimum investment to be reduced to $800,000 instead of the standard $1.05 million.


      

    The required documents for the I-526 petition typically include:

    • Proof of the investment funds (source of funds documentation)
    • Business plan for the EB-5 investment
    • Evidence that the investment meets the job creation requirements
    • Personal identification documents (passport, birth certificates, etc.)
    • Proof of legal entry (if applying for adjustment of status in the U.S.)
    • Other financial and legal documents related to the investment


    To prove the source of funds, you must provide a detailed explanation and documentation showing the legal origin of the funds you are investing. This can include tax returns, business records, bank statements, and other financial documents. The USCIS requires proof that the funds were obtained legally and are not from illegal sources. 


    The Child Status Protection Act (CSPA) allows certain children who turn 21 during the EB-5 application process to retain their eligibility as dependents for the purpose of immigrating with their parents. CSPA protects the child’s status if they turn 21 after the EB-5 petition is filed, but it is a complex determination and should be reviewed with an immigration attorney. 


     

    • Consular Processing: If you are outside the U.S., you will apply for your immigrant visa through a U.S. embassy or consulate in your home country after I-526 approval.
    • Adjustment of Status: If you are already in the U.S., you can apply for an adjustment of status to become a lawful permanent resident without leaving the country, after your I-526 petition is approved.


     Yes, once you receive your conditional green card, you can travel outside the U.S. freely, but be mindful that staying outside the U.S. for extended periods may affect your status. If you plan to travel for more than 6 months, you may need to apply for a reentry permit to avoid losing your green card status. 


     Yes, you can continue living in your home country while your EB-5 petition is being processed. However, once your petition is approved, you will need to attend an interview at a U.S. consulate if you are applying from abroad (for consular processing). 


     Yes, individuals already in the U.S. on a valid visa (such as  F-1, H-1B, or L-1) can apply for the EB-5 visa through Adjustment of Status. This allows you to remain in the U.S. while your application is processed, without having to leave the country.


    Adjustment of Status (AOS) is the process through which you apply to change your non-immigrant status (such as student, tourist, or worker) to that of a permanent resident (green card holder) without leaving the U.S. Once your I-526 petition is approved, you can apply for AOS to receive your conditional green card. 


     If you are currently out of status in the U.S., it may be more complicated to apply for the EB-5 visa. However, it’s possible to apply for Adjustment of Status as long as you haven't overstayed for a long period. It's important to consult with an immigration attorney to navigate your specific situation.
